Terms of Service
These Terms of Service ("Terms") govern product inquiries, quotes, orders, and purchases of fertilizer products from Richfield Sulphur Solutions, Inc. ("Richfield Sulphur Solutions," "we," "us," or "our"). By submitting an inquiry, requesting a quote, or placing an order with us, you agree to these Terms.
Fertilizer Product Sales
Richfield Sulphur Solutions manufactures and sells sulphur-based fertilizer product, including our sulphur-bentonite fertilizer product line, to agricultural distributors, commercial customers, and other applicable buyers. All sales are subject to these Terms and any additional terms agreed to in writing between Richfield Sulphur Solutions and the customer.
Product Inquiries
Product inquiries submitted through our website, by email, or by phone are used to provide information about our products and to begin the process of preparing a quote or order where applicable. Submitting an inquiry does not by itself create a binding order.
Quotes and Pricing
Quotes are provided upon request and reflect pricing, quantities, and terms applicable at the time the quote is issued. Quotes may be subject to change and, unless otherwise stated in writing, are not binding until accepted by both parties and confirmed as an order.
Product Availability
Product availability is confirmed at the time of inquiry or order and is subject to change based on production schedules and existing commitments.
Commercial Orders
Orders are accepted at the discretion of Richfield Sulphur Solutions and become binding once confirmed by us in writing. Order details, including product, quantity, pricing, and delivery terms, will be documented at the time of confirmation.
Customer Specifications
Where a customer provides specific requirements or specifications for an order, we will work with the customer to confirm whether those specifications can be accommodated. Any agreed-upon customer specifications will be documented as part of the order confirmation, where applicable.
Payment Terms
Unless otherwise agreed in writing, orders are payable on an invoice basis. Where applicable, orders may require a deposit or other payment terms, which will be communicated to the customer prior to order confirmation.
Order Changes and Cancellations
Requests to change or cancel an order must be submitted to our team as soon as possible. Changes and cancellations are subject to the status of the order at the time of the request, including any production or fulfillment work already underway.
Production and Fulfillment Schedules
Production and fulfillment schedules for confirmed orders will be communicated to the customer at the time of order confirmation and may be affected by factors such as material availability and existing production commitments.
Shipping and Export Logistics
Where applicable, shipping and export logistics for an order, including responsibility for arranging or coordinating transportation, will be discussed and confirmed with the customer as part of the order process. Customers are responsible for compliance with any import requirements applicable in their own country or region.
Receiving and Inspection
Customers are responsible for inspecting product upon receipt and for promptly notifying Richfield Sulphur Solutions of any concerns regarding the condition or quantity of product received.
Product Documentation
Where product documentation, such as a data sheet or shipment-related documentation, is provided in connection with an order, it will be provided directly to the customer. Richfield Sulphur Solutions does not guarantee the availability of documentation beyond what is actually provided in connection with a given order.
Limitation of Liability
To the fullest extent permitted by applicable law, Richfield Sulphur Solutions, Inc. shall not be liable for any indirect, incidental, special, or consequential damages arising from or related to product inquiries, quotes, orders, or the sale of our products. Our total liability for any claim arising from a purchase shall not exceed the amount paid by the customer for the applicable order.
Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of laws principles.
Changes to These Terms
We may update these Terms of Service from time to time. Any changes will be reflected on this page along with an updated "Last updated" date.
